    These Terms of Service ("Terms") govern your use of the Iris mobile application ("App") operated by Iris ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms.

    1. Eligibility

    You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

    2. Account Registration

    2.1 Google Sign-In

    The App requires authentication via Google Sign-In. By signing in, you authorize us to access your Google account information (name, email, profile photo) and, with your explicit consent, your Gmail inbox in read-only mode for the purposes described in our Privacy Policy.

    2.2 Account Security

    You are responsible for maintaining the security of your Google account. We are not liable for unauthorized access to your Iris account resulting from compromised Google credentials.

    3. Description of Service

    Iris is a personalized podcast app that:

    • Connects to your Gmail to discover newsletter subscriptions
    • Generates AI-powered audio summaries of your newsletters on a daily schedule
    • Allows you to save and listen to web articles

    The App uses artificial intelligence to summarize newsletter content and generate audio. AI-generated content may contain inaccuracies or omit important details from the original source material.

    4. Subscription Tiers

    4.1 Free Tier

    The free tier includes:

    • Newsletter discovery and podcast episode generation
    • Up to 10 saved articles at a time
    • Saved articles expire after 7 days
    • Audio episodes are retained for 3 days
    • Access to standard voices

    4.2 Pro Tier

    The Pro tier includes:

    • All free tier features
    • Unlimited saved articles with no expiration
    • Audio episodes retained for 14 days
    • Premium voice options
    • AI-generated audio read-alouds for saved articles

    4.3 Billing and Cancellation

    Pro subscriptions are billed through Apple's App Store. Subscription management, billing, and cancellation are governed by Apple's terms. You may cancel your subscription at any time through your device's subscription settings. Cancellation takes effect at the end of the current billing period.

    4.4 Downgrade

    If you cancel your Pro subscription, your account will revert to the free tier at the end of your billing period. Saved articles exceeding the free tier limit may become inaccessible and subject to automatic expiration.

    5. Acceptable Use

    You agree not to:

    • Use the App for any unlawful purpose
    • Attempt to gain unauthorized access to our systems or other users' data
    • Reverse engineer, decompile, or disassemble the App
    • Use the App to send, store, or process content that is illegal, harmful, or violates third-party rights
    • Circumvent or manipulate subscription restrictions or access controls
    • Use automated scripts, bots, or scrapers to interact with the App
    • Resell, redistribute, or sublicense access to the App or its content

    6. Intellectual Property

    6.1 Our Property

    The App, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited license to use the App.

    6.2 Your Content

    You retain ownership of any content you provide to the App (such as article URLs you share). By using the App, you grant us a limited license to process your content solely for the purpose of providing the App's features.

    6.3 AI-Generated Content

    Podcast episodes and summaries generated by the App are derived from third-party newsletter and article content using AI. We do not claim ownership of the underlying source content. The AI-generated audio is provided for your personal, non-commercial use only.

    7. Third-Party Services

    The App relies on third-party services including Google, OpenAI, Replicate, and others described in our Privacy Policy. We are not responsible for the availability, accuracy, or policies of these third-party services. Changes to or outages of third-party services may affect the App's functionality.

    8. Disclaimers

    8.1 "As Is" Service

    THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

    8.2 AI Content Accuracy

    We do not guarantee the accuracy, completeness, or reliability of AI-generated summaries or audio content. AI-generated content is not a substitute for reading the original source material. You should not rely on AI-generated summaries for critical decisions.

    8.3 Gmail Access

    We do not guarantee uninterrupted access to your Gmail data. Google may revoke or limit API access at any time, which could affect the App's ability to generate briefings.

    9. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

    • YOUR USE OF OR INABILITY TO USE THE APP
    • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
    • ANY AI-GENERATED CONTENT PRODUCED BY THE APP
    • ANY THIRD-PARTY SERVICE INTERRUPTION OR FAILURE

    10. Indemnification

    You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

    11. Termination

    11.1 By You

    You may stop using the App at any time and request account deletion by contacting us at info@joiniris.dev.

    11.2 By Us

    We may suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

    11.3 Effect of Termination

    Upon termination, we will delete your account data in accordance with our Privacy Policy. Provisions that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will survive.

    12. Changes to These Terms

    We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or by other reasonable means. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

    13. Governing Law

    These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

    14. Dispute Resolution

    Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

    15. Severability

    If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

    16. Entire Agreement

    These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App.
